Scalia Criticizes “Scalito” Mike Rappaport

In Zedner v. US, Justice Alito, writing for the Court, employed legislative history to interpret a statute that was  unambiguous.  Justice Scalia concurred to criticize this practice.  Well, here is one way the two justices differ.  That’s fine, but let’s not make a practice of it!
