Class action attorney Lerach hit with fee ruling Tom Smith

This is pretty rich.  A Texas federal district judge says the plaintiff’s law firm (Lerach’s) must pay the defendant’s fees under 11(e) because it did not advise the plaintiff to drop the suit once it became clear it lacked merit.  This could become important, and I certainly hope it does. (hat tip DK)  It may not make any difference than regular old 11(e) though, because presumably the fee agreement with the plaintiff client could require the plaintiff to indemnify his lawyer against such cheeky judicial behavior.
