Some of you read James Allan s essay on the mass retirement of USD s more conservative law faculty members. At the time of the essay, the count was four Larry Alexander, Kevin Cole, Steven Smith, and me. Well, you can add one more Tom Smith. This is a three-year process for all of us. We won t be out the door till 2025. But if you know somebody who was considering attending USD School of Law because of its reputation for having an ideologically diverse faculty (we do get a fair number of those), you may want to give them the bad news. There are still a few conservative faculty members left, but their numbers are dwindling fast.

Yes, it’s true — I am retiring from my post at my small and merely formerly cute university, effective 2025, but in truth more like two semesters from now. I tried to follow what I called the Dirty Bird principle, as in, it’s a dirty bird that fouls its own nest, thinking that if I limited myself to the destruction and depravities occurring in the world at large and not in my little piece of paradise in the sunshine, I would be left alone. But alas, it was not to be. The CCP and its little helpers around the world (IMHO) managed to reach out and touch little old me, and that experience really rather soured me on what had been I job I liked. (Whether there was some Lt-jg deep in the bowels of some office building in Beijing with responsibility for activities at private universities in SoCal, I don’t know, but I got some sweet emails suggesting some folks over there were paying attention, so there’s that.) And for suggesting (if rather rudely) that one should not take the Communist Party of China’s explanations for that pesky little grandma killer virus they evidently cooked up in their lab, at face value. Talk about not being able to take a joke. But I’m determined to hold to the Modified Dirty Bird Principle, under which I won’t say mean things about my law school, well, just because you never know. But the CCP, of course, can go f*** yourselves. You know who you are.
