Oberlin College Sues Insurers For Refusing To Cover $36 Million It Paid Gibson s Bakery For Defamation And Other Torts

Back when giants roamed the earth, I worked for a big law firm that had a prominent practice representing corporations trying to get their insurers to pay up. One typical case involved an underground fuel storage tank and the contaminated soil around it. The policy said it covered fuel leaks only that were sudden and accidental. It was shown this tank leaked about, I don’t know, a dozen molecules a day. Anything but sudden and accidental, or so you would think. But after our firm applied its interpretive magic, the insurer would pay up, no doubt wondering what it could have said that would have protected it. That’s insurance litigation for you. I hope Oberlin has to pay as well, but who knows.
