Texas Asks Supreme Court To Overturn Biden s Win In Last-Ditch Election Lawsuit

Texas Attorney General Ken Paxton, who s leading the lawsuit, alleges the battleground states acted unconstitutionally by changing their voting rules to expand access amid the Covid-19 pandemic.

Paxton alleges that changing the voting rules opened the door to election irregularities in various forms, making claims about voter fraud and impropriety in the election process that have been repeatedly struck down by other courts as not being supported by evidence.

Texas is asking the Supreme Court to say the states election results are unconstitutional and can t be counted, and order a special election to appoint presidential electors, for state legislatures to appoint them instead, or to just not have the states appoint any presidential electors at all.

The case was brought directly to the Supreme Court because the high court has jurisdiction to hear challenges between states, rather than going through lower courts first.

Legal experts responded to news of the lawsuit s filing by criticizing it as insane and a new leader in the craziest lawsuit filed to purportedly challenge the election category, with election law expert Rick Hasen describing the suit as utter garbage and a press release masquerading as a lawsuit.

Well, let’s remember what the several law professor experts say about this case and check back later. That’s it’s crazy, a non-starter, garbage, etc. ConLaw is not really my area, but I see this as a plausible suit. I should think it will get at least three votes to hear it, and I think Texas makes a good point that cases like this should be mandatory jurisdiction. Actually I would say it’s a winning case, but that means little in the sad, disordered world in which we live. I think the most likely conservatives to peel off are Kavanaugh and Gorsuch, but I bet Texas gets Thomas, Alito and Barrett. Three out of nine votes does not make you “crazy.” But we’ll see.
