Can a businessman pay hired muscle to kidnap his longtime partner with whom he is locked in pricey litigation, plead guilty to a federal crime in the alleged murder-for-hire plot and still prevail in his lawsuit against the man prosecutors say he wanted dead?

That s the question a judge will soon decide after presiding over a recent civil trial in San Diego Superior Court.
